Markey v. Gomez: The Massachusetts Senate Race

With a few days left to go, this race is officially a snoozer.  Ed Markey is a fine Representative and will make a fine Senator but somehow I can’t work up any enthusiasm.  You know, if you read this blog with any regularity, that I am a campaigner and it is a measure of something that I haven’t done much of anything for Ed except throw him a few bucks and vote in the primary where he was unopposed.  I think the race would have been a lot more exciting if someone like Mike Capuano were running, but too late for that.  Maybe we should just feel sorry for these guys since after the Elizabeth Warren – Scott Brown tussle almost anything would seem dull.  This is the assessment of the race from the Daily Kos Election update for June 21.

MA-Sen: Gabriel Gomez has gotten some “next Scott Brown” hype, to the extent that he’s a moderate Republican who’s a fresh face and running in a Massachusetts Senate special election (which will be held next Tuesday) against a charisma-challenged Democrat. However, there’s one important element that seems missing: the ability to mount a late surge and actually win the race, at least if the newest public poll is any indication. UMass Lowell, on behalf of the Boston Herald, gives Ed Markey his biggest lead of any pollster who’s looked at the race so far: among likely voters, Markey leads Gomez 56-36 (and 53-32 among all registered voters). This is the pollster’s first look at the race since the primary; they did poll the general way back in early March, and found an almost identical margin (47-28 for Markey).

Most pollsters have shown a closer race, usually in the high single digits, although the last couple public polls (from UNH for the Boston Globe, and from Harper Polling) both had it in the low teens; only one recent poll (a Suffolk poll with a 17-point margin in early May) had anything similar to this one.   And then there’s the GOP internal pollsters, who continue to see the race within low single digits; the most recent of these came out Thursday from McLaughlin, with Markey up 47-44. That follows a McLaughlin poll from two weeks ago with Markey up 45-44 (on behalf of donor John Jordan), in addition to two OnMessage polls directly on behalf of Gomez, one from less than a week ago with Markey up 47-40, and one from early May with Markey up 46-43. It’s not clear what the GOP hopes to gain from constantly leaking those polls, since most observers know that leaked internal polls usually overstate support for their candidate and none of these best-case-scenarios still manage to have Gomez winning.   The 47-44 topline is all that McLaughlin leaked to Politico, but Dave Weigel seems to have gotten his hands on the crosstabs, which show Gomez’s favorables falling from 48/27 to 41/35, while Markey’s are up a little, from 42/42 to 47/40. Again, not a sign of progress for Gomez, though maybe the GOP thinks the toplines are enough to convince donors that it’s not entirely a lost cause. (Although donations at this point would probably arrive too late to do anything other than last-minute GOTV.)

As for the original Scott Brown, the ex-Senator had publicly said that he was willing to campaign for Gomez as his schedule permitted, but so far he hasn’t done anything (apparently impeded by his busy dual careers of lobbying and appearing as a Fox News analyst). Well, he is finally popping up: he’ll be appearing at a rally with Gomez on Monday night, the night before the election. Is it really a case of a busy schedule, or just not wanting to let Gomez’s likely loss appear to be a referendum on Brown himself (especially considering that he may still get in to the Massachusetts gubernatorial race… or the New Hampshire Senate race)?

And if you’ve gotten the impression that Massachusetts voters are responding to the Ed Markey vs. Gabriel Gomez special election with a collective yawn, now we’ve gotten some quantitative proof. Absentee ballot requests are down significantly from the 2010 special election that elected Scott Brown; only 49.7K ballots have been requested, compared with 63.6K at the comparable point in 2010. The absentee ballot application deadline is on Monday, one day before the election.

I won’t be home on Tuesday so I’ve already voted absentee – for Markey.

Voting in America

We all saw the lines on television last November. A lot of us stood in them.  In Florida, in Ohio.  I saw at least a 20 minute wait on election morning as I timed a friend who went into vote while I was outside handing out Warren/Obama literature.  This was much longer than usual at my precinct.  It turns out that these are only the outward manifestations of larger problems.  President Obama has said fixing the problems is one of his priorities.  Now he can look at a couple of studies to see exactly what needs to be fixed.

First the Daily Kos posted a story about the MIT study showing that black and Hispanic voters waited longer to vote than other voters.

You’d think after two hundred years (including some awkward Constitution-patching, here and there) we would finally have this “voting” thing down. Nope:

A Massachusetts Institute of Technology analysis determined that blacks and Hispanics waited nearly twice as long in line to vote on average than whites. Florida had the nation’s longest lines, at 45 minutes, followed by the District of Columbia, Maryland, South Carolina and Virginia, according to Charles Stewart III, the political science professor who conducted the analysis.

So how are states going to fix this?  Maybe by making it harder to register and then harder to vote.

…In states like Virginia, in fact, they’re still trying their level best to make sure certain people don’t have to wait in long lines to vote by making sure certain people aren’t allowed to vote at all. Newly passed legislation would:

eliminate the use of a utility bill, pay stub, bank statement, government check and Social Security card as acceptable identification that can be presented at the polls. Voters would still be able to use a voter identification card, concealed handgun permit, driver’s license and student ID card.

Well, so long as you’re still taking concealed handgun permits.

Since most of those now-banned documents are still perfectly acceptable for obtaining “real” ID’s, like drivers licenses, the possibilities for thwarting rampant voting fraud are approximately nil. The only substantive outcome is to make it ever more inconvenient for certain people (i.e. poor, elderly, and those that don’t have cars, those city-living bastards) to vote.

So I’m not sure that we can depend on states to fix their own problems.

On the heels of the MIT study comes Pew Research.  The New York Times reported on the study which looked at 17 factors.

The flaws in the American election system are deep and widespread, extending beyond isolated voting issues in a few locations and flaring up in states rich and poor, according to a major new study from the Pew Charitable Trusts.

The group ranked all 50 states based on more than 15 criteria, including wait times, lost votes and problems with absentee and provisional ballots, and the order often confounds the conventional wisdom.

In 2010, for instance, Mississippi ranked last over all. But it was preceded by two surprises: New York and California.

The project includes an interactive tool that allows rankings by individual criteria or clusters of them.

Some states, for instance, lost very few votes because of shortcomings in voting technology and voter confusion, with the best 10 reporting failure rates of 0.5 percent or less in 2008. In West Virginia, by contrast, the rate was 3.2 percent.

I hope you will click on the interactive link and look up your state.  The study covers the 2008 and 2010 elections and will be updated with 2012 data when it is available.  Massachusetts is only ranked in the middle at 64% overall which is interesting as I would have guessed it would have been higher.

The study also covered the new trend of voting by mail.

The shift to voting by mail, which now accounts for some 20 percent of all ballots cast, tends to eliminate lines. But it has also produced new problems, especially in places where mail voting has soared because the state does not require an excuse or a new ballot request for each election. Arizona and California, where voting by mail is commonplace, had among the highest rates of problems with voter registration and absentee ballots.

In 2010, California rejected absentee ballots 0.7 percent of the time, a higher rate than any other state.

Dean C. Logan, the registrar for Los Angeles County, said the rate was partly a byproduct of the popularity of voting by mail in California and partly a function of how the state defines rejected ballots. Its definition includes ballots that voters requested but that the Postal Service returned to election officials as undeliverable.

“Voter behavior is changing and evolving,” Mr. Logan said. Young people do not sign their names as consistently as older ones, he said, and mail delivery is becoming less reliable.

He also cautioned that statewide results can mask the fact that “the elections process is extremely decentralized.”

Provisional ballots are also a potential problem according to the study.

Charles Stewart III [cited also by the Daily Kos], a political scientist at the Massachusetts Institute of Technology and a Pew adviser, said that high provisional ballot rates were an important signal of potential trouble.

“Nationwide, a bit over 1 percent of voters are given a provisional ballot,” he said. “In Arizona in 2008, the rate was 6.5 percent. In the battleground state of Ohio, it was 3.6 percent. While these numbers may seem small, in a recount or election dispute, they would be huge.”

There are lots of things to consider as we look at ways to fix things.  How can people more easily register to vote?  What kind of ID, if any, should a voter have to show?  Do we vote by mail?  Online?  In person?  How many options should voters be offered?  I don’t know how many of the issues raised by the Pew study are local and how many can be federally mandated.  I believe that the federal government may have more say if the election is for a national office and is not just a state or local election.

I hope we can tackle some of these issues before 2014 and more of them before 2016.

Professor Stewart said the study should focus attention on the infrastructure of democracy.

“Among all important areas of public policy, election administration is probably the most episodic and prone to the problem of short attention spans,” he said. “What would the world be like if we only gave intense attention to education, corrections, transportation and public health problems for a one-week period every four years?”

Hopes for Obama 2.0

I thought this was a good summary of President Obama’s first term and what we hope can be avoided.

And they are still working on it.  Just look at Mike Luckovich

The more things change the more they stay the same.  John McCain is mischaracterizing Hillary Clinton’s testimony and it looks, right now like Harry Reid is going to cave on filibuster reform after all but it is an evolving situation.

And if you want another sign that nothing has changed, John Boehner is accusing Obama of destroying the Republican party.  I think they are doing a pretty good job without the President’s help.

The “old” House votes on the fiscal cliff

David Jarman posted an interesting analysis of the voting on the Senate Bill to dodge the fiscal cliff in which he credits Nancy Pelosi for getting it done.  Here are some of the highlights.

Tuesday’s House vote on the fiscal cliff is one of those rare votes where you don’t get a straight party line vote like most contentious votes, but one where the House shatters into pieces and the winner is the side that reassembles the most fragments. Of course, this time it was Nancy Pelosi who did that, putting together a strange coalition of most of the Dems (minus a few defections on the caucus’s left and right flanks), plus the bulk of the establishmentarian and/or moderate Republicans (including the vote of John Boehner himself, no “moderate” but certainly “establishment”).

On the Republican side, there were 85 yes and 151 no votes (with 5 non-votes, from Ann Marie Buerkle, Dan Burton, Sam Graves, Jerry Lewis, and Ron Paul). That’s too many votes to replicate the entire list, but there was a significant geographic dichotomy here, one that seems to support the larger idea that the GOP is increasingly becoming a regional rump party.

Of those 85 yes votes, only 13 were Republicans from the Census-defined “southern” states, and many of those were either ones with ties to leadership (ex-NRCC chairs Tom Cole and Pete Sessions, Appropriations Chair Hal Rogers) or ones with atypical, moderate districts in Florida (Mario Diaz-Balart, Ileana Ros-Lehtinen, Bill Young). Rodney Alexander, Kevin Brady, Howard Coble, Ander Crenshaw, John Sullivan, Mac Thornberry, and Steve Womack, most of whom are also pretty establishment-flavored, round out the list.

And how did the Democrats vote?

On the Democratic side, there were 172 yes and 16 no votes (with 3 non-votes, from Pete Stark, Lynn Woolsey, and John Lewis). Within those 16, though, there seem to be two camps: Xavier Becerra, Earl Blumenauer, Peter DeFazio, Rosa DeLauro, Jim McDermott, Brad Miller, Jim Moran, and Bobby Scott (most of whom are Progressive Caucus members) voting against it from the left, and John Barrow, Jim Cooper, Jim Matheson, Mike McIntyre, Colin Peterson, Kurt Schrader, Adam Smith, and Pete Visclosky (most of whom are Blue Dogs) voting against it from the right.

It may not be that simple, though: DeFazio has in recent years been one of the likeliest members of the Progressive Caucus to stray from the party line (for example, he voted against both the Progressive budget and even the leadership budget last year); it’s increasingly hard to tell if he’s becoming more conservative or if DeFazio, always irascible, has just gotten more willing to dig his heels in on bills that feel like half-measures. Adam Smith, on the other hand, has generally been a New Democrat establishment-type player, but he might be looking to remake himself a bit with his newly configured, much more liberal district, which now contains a slice of Seattle. And Moran and Visclosky, even though Moran (who represents northern Virginia) is significantly more liberal than Visclosky, are probably coming from the same mindset, whatever that might be; they’re tight, and are some of the last remaining members of that John Murtha/Norm Dicks appropriations clique that didn’t really fit within any of the Dem caucuses.

Jarman doesn’t talk about Bobby Scott and John Lewis but both are in the Black Caucus as well as in the Progressive Caucus.  Lewis just didn’t vote, but Bobby (who I knew from back in my Virginia Days) represents a district that touches Eric Cantor’s and he might also have had the conservative white voter from his district in mind.

Jarman leaves us with this to think about

Fifteen of the GOP “yes” votes were members who, either because of defeat or retirement, won’t be coming back (Charlie Bass, Judy Biggert, Brian Bilbray, Mary Bono Mack, Bob Dold, David Dreier, Jo Ann Emerson, Elton Gallegly, Nan Hayworth, Tim Johnson, Steve LaTourette, Dan Lungren, Todd Platts, John Sullivan, and Bob Turner). Twenty end-of-the-liners, however, voted “no” (Sandy Adams, Todd Akin, Steve Austria, Rick Berg, Quico Canseco, Chip Cravaack, Jeff Flake, Frank Guinta, Connie Mack, Sue Myrick, Mike Pence, Ben Quayle, Denny Rehberg, David Rivera, Bobby Schilling, Jean Schmidt, Tim Scott, Cliff Stearns, Joe Walsh, and Allen West), though I suspect some of the more establishment-flavored names on that list would probably have been willing to offer a “yes” if the vote had looked closer than it actually was.

Tomorrow starts a new Congress so we can’t really look to this vote when we are reading the tea leaves about the upcoming fight on the debt ceiling and the budget.  There will be more Democrats – enough so Nancy Pelosi won’t need so many Republican votes (I think it may be 21, 17 with vacancies) – if John Boehner can be persuaded to bring things to the floor.
